1. About Eaziflow and these terms
Eaziflow | TakeOut provides software that lets independent restaurants publish menus, receive direct orders, manage fulfilment and show order-status tracking. The platform is available at eaziflowtakeout.co.za and can be contacted at eaziflowtakeout@gmail.com.
By creating a restaurant account or submitting a customer order, you agree to the parts of these terms that apply to you. Eaziflow is the technology platform. The restaurant identified on each storefront is the food supplier and seller, and is responsible for its food, menu information, prices, preparation, payment collection, fulfilment, delivery and customer service.
2. Customer orders
An order submitted through the platform is an offer to buy from the restaurant. A binding order is formed only when the restaurant accepts it. The tracking page records the current order status; customers should keep their private tracking link secure.
Customers must provide accurate contact and delivery information, be available to receive the order, and use the service lawfully. Estimated preparation and delivery times are not guarantees and can change because of restaurant conditions, traffic, weather or events outside reasonable control.
3. Prices and payment
Menu prices, delivery fees and minimum-order rules are set by the restaurant. The full order total is shown before submission and is recalculated from the restaurant’s current menu. Customers can review and correct the order and their details before selecting “Place order”.
Eaziflow does not take customer card payments. Payment is made directly to the restaurant by cash, cash on delivery or the restaurant’s card machine, according to the option selected and the restaurant’s available methods. The restaurant is responsible for receipts, payment disputes and any refund that is due.
4. Food information and allergens
The restaurant is responsible for menu descriptions, ingredients, availability, dietary statements and allergen information. Customers with an allergy or specific dietary need should contact the restaurant before ordering and add a clear note to the order. A note does not guarantee that cross-contamination can be prevented.
5. Changes, cancellations and refunds
Customers should contact the restaurant as soon as possible to request a change or cancellation. A restaurant may reject an order before acceptance. After acceptance, whether a change, cancellation or refund is available depends on preparation status, the restaurant’s disclosed policy and applicable consumer law. Nothing in these terms limits a non-excludable right under South African consumer law.
6. Restaurant accounts and subscriptions
Restaurant owners must be legally able to contract, provide accurate business and contact information, keep menu, trading-hour, delivery-area and pricing details current, and protect their account access. Owners control team access and must use customer information only for lawful restaurant operations.
Current subscription pricing, limits, taxes where applicable and included features are shown before a restaurant chooses a plan. Trials end on the stated date. Paid subscriptions are billed using the agreed offline or invoiced process until another billing method is introduced. We will give reasonable advance notice of material price or plan changes. A configured grace period may apply after an account is marked past due. Paused, expired or cancelled subscriptions lose customer ordering and plan-gated features, but pausing access does not itself delete stored data.
7. Restaurant content and customer responsibilities
Restaurants retain rights in the logos, images, menu content and other materials they upload and grant Eaziflow a non-exclusive licence to host, process and display that content only as needed to provide, secure and support the service. Restaurants warrant that they have the necessary rights to use uploaded content.
Customers and restaurant users may not submit fraudulent orders, impersonate another person, upload unlawful or infringing content, attempt unauthorised access, interfere with the platform, scrape non-public data or use the service in a way that harms Eaziflow, restaurants or customers.
8. Availability and third-party services
We aim to provide a reliable service, but availability can be affected by maintenance, hosting, authentication, email and other third-party services, internet failures and events beyond reasonable control. We may improve or replace features and will aim to give reasonable notice where a material change affects restaurant operations.
9. Intellectual property
Eaziflow’s software, platform design and branding remain protected by applicable intellectual-property law. Except for the limited right to use the platform under an active account, no Eaziflow intellectual-property rights are transferred to a restaurant or customer.
10. Liability
Nothing in these terms excludes or limits rights or liability that cannot lawfully be excluded or limited. To the extent permitted by law, Eaziflow is not responsible for the quality or safety of food, restaurant conduct, delivery performance, restaurant-managed payments, or loss caused by inaccurate information supplied by a restaurant or customer. Eaziflow is not liable for indirect or consequential loss where such an exclusion is lawful.
11. Suspension, cancellation and termination
Eaziflow may restrict or suspend an account when reasonably necessary for security, non-payment, unlawful use, serious misuse or protection of the platform and its users. Restaurant subscriptions can be cancelled immediately or at the end of the current period as recorded in the SaaS dashboard or agreed with support. Terms concerning payment, confidentiality, intellectual property, liability and lawful record retention continue where their nature requires it.
12. Privacy and electronic communications
Use of personal information is described in the Privacy Notice. An electronic message to Eaziflow is treated as received when Eaziflow acknowledges it. These terms, the checkout summary and the order record form the electronic record of the transaction.
13. Complaints, disputes and applicable law
Questions or complaints should first be sent to eaziflowtakeout@gmail.com. Customer complaints about food, delivery, payment or fulfilment should also be sent directly to the restaurant shown on the order.
These terms are governed by the laws of South Africa and disputes are subject to South African courts, without limiting any mandatory right to approach the National Consumer Commission, the Information Regulator or another competent body.
14. Changes to these terms
We may update these terms when the service, law or providers change. The latest version and effective date will remain available on this page. Material changes affecting restaurant subscriptions will be communicated through the dashboard, account email or another reasonable channel before they take effect where practicable.
